Negotiate the Best Agreement
As individuals, it is a bit unnerving to receive binding documents that require our signature. Some are more complicated than others. Be of the mindset to do your due dilligence. The following steps are provided to help you through the process whether simple or complex.
First Read
Honestly decide whether the document appears reader friendly for you. Quickly scan as to whether you will devote due diligence to the matter in order to potentially put your name to it.
Second Read
Passing the test of the first read, set quiet time aside to carefully read through the document, paragraph by paragraph. Make note of anything that you do not understand, disagree with, or you find contradictory. On occasion, words are misspelled or grammar is out of sync. Make note of all instances that concern you.
You are putting your name to the document, and so professionalism is required on every level. Compile all of your notes for an insightful discussion BEFORE you authorize the document.
Discuss
Ask for a conversation to go over the fine print with the originator of the document. In a friendly manner let it be known your need clarification on points covered in the document. Unless there is something to be hidden, the meeting will be granted.
Legal Help
Some documents are just too difficult for those not trained in the legal field to understand. We can fool ourselves believing we do understand in order to save money, but frequently that is referred to as “shooting yourself in the foot”. After the fact, there is no recourse.
You may already have an attorney in your employ or know someone whom you trust. Additionally, there are reasonable plans on the market that entitle you to on-going assistance for legal matters such as difficult documents or identity theft, and beyond. An appointed attorney will point out where you may potentially encounter difficulty ahead.
Negotiation
You have the right to express your concern on particular points, and ask for changes to the agreement. Some changes may be agreed to while others not. Your job is to acknowledge either having to walk away from the impending agreement, or accept it embracing a logical and non-emotional stance.
